Keeping Cars
Many clients are curious as to whether they can keep their vehicles in a Chapter 7 bankruptcy. Often times, the answer is yes. If a debtor is current on their vehicle when they enter into a Chapter 7 bankruptcy and remains current through their Chapter 7 bankruptcy, they will keep their vehicle.
Some lenders require that a reaffirmation be signed in order to keep the property. The number of lenders now requiring a Reaffirmation Agreement are exceedingly few. If your lender requires a Reaffirmation Agreement, your attorney will let you know.
